In short
- The Netherlands is rebuilding its box 3 tax on savings and investments: instead of a notional return, the actual return would be taxed (Wet werkelijk rendement box 3, no. 36.748).
- The Tweede Kamer passed it on 12 Feb 2026. After its debate on 30 Jun 2026, the Eerste Kamer postponed its vote and is waiting for an amending bill. It is not law; until then the current box 3 system applies.
- The original bill would tax unrealised changes in value every year as well, with real estate and start-up shares only on sale. The amending bill would extend taxation on sale from 2028.
- Separately, this already applies today: if you leave with a stake of 5% or more, you get a protective assessment (conserverende aanslag) in box 2.
- Liechtenstein doesn't change Dutch rules. If you're considering a move, check box 2 and box 3 case by case.

Wet werkelijk rendement box 3
- The actual return would be taxed, under the bill including unrealised changes in value. Real estate and start-up shares only on sale (Eerste Kamer, Dutch).
- Tweede Kamer: passed on 12 Feb 2026.
- Eerste Kamer: plenary debate on 30 Jun 2026, vote postponed. On 13 Oct 2026 the committee decided to wait for the amending bill.
- Until a decision, the current box 3 system applies.

Amending bill from 2028
- Cabinet letter on 29 Sep 2026, cabinet approval on 2 Oct 2026, since then with the Council of State for advice (Wetgevingskalender, Dutch).
- Aim: extend taxation on sale (vermogenswinstbelasting) from 2028.
- In the government's scenario letter this variant (scenario 4) means all financial instruments such as shares, bonds and options from 2028, other assets from 2030 (letter to parliament, 13 Sep 2026, Dutch). The exact scope depends on the text of the amending bill.
- Handling in the Tweede Kamer is pending.
NLlaw
Leaving with a stake: box 2
- If you leave with a stake of 5% or more, the tax is secured by a conserverende aanslag (Belastingdienst, Dutch).
- It falls due on a sale or a dividend, for example.
- For moves since 15 Sep 2015, there is no remission after 10 years any more.
As of 1 Nov 2026. New box 3: in parliament, not law. Box 2 on departure: law in force.
What it honestly means
On box 3 many already read "tax on paper gains from 2028". The status is more open. Three things matter:
- Nothing is fixed yet. The Eerste Kamer hasn't voted and the amending bill is with the Council of State. If you're making decisions now, plan with scenarios and get advice.
- Substance, not a mailbox. An address alone is neither a residence nor a company seat. If you build something in Liechtenstein, you need a real presence: a registered company with its seat and desks on the ground, a team, and decisions made here. More: Substance in Liechtenstein.
- Box 2 applies today. If you hold 5% or more of a company and leave, the protective assessment comes with you, without a time limit. Double taxation questions come on top: Double taxation and Liechtenstein.
Why we still like talking about Liechtenstein: the environment is predictable. Founders plan in years, not in headline cycles.
